1. “Paralympic Day” and “Paralympic Day Walkathon” (collectively the “Event”) is organised by Singapore National Paralympic Committee and its Official Event Partner, Funco Private Limited (hereinafter referred to as “Organisers”).
2. These Terms and Conditions shall be read together with any other rules and/or terms and conditions applicable to the Event, and shall apply to all segments of the Event. By registering for this Event, you agree to be bound by these Terms and Conditions and all rules relating thereto.
3. By registering for this Event, you acknowledge that you are fully aware of the nature of the Event and the potential risks involved, and you accept all risks associated with the Event and the activities offered during the event. Without limitation to the foregoing, you confirm that you are not suffering from or receiving treatment for any medical conditions, illness, injuries, allergies or diseases which may render it unsafe for you to participate in the Event. It is the sole responsibility of each participant to check and ensure that he/she is at all times medically and physically fit to participate in the activities relating to the Event. Each participant will also be required to sign or accept an Acknowledge, Release and Indemnity in the form prescribed by the organisers.
4. Participants below 18 years old must obtain the consent of his/her parent or legal guardian before participating in the Event and shall ensure his/her parent or legal guardian acknowledge and agree to these Terms and Conditions.
5. Each participant hereby expressly agrees and acknowledges that the organisers shall be under no liability whatsoever to the participant(s) or the participant(s)’ personal representatives, in respect of any loss, damage suffered by the participant(s) arising from or pursuant to the Event or for any loss, damage or injury to life or property sustained by the participant(s) during or in connection with the Event.
6. The participant acknowledges and agrees that he/she may be audio or video taped and photographed while participating in the Event, whether or not the participant is aware that he/she is being taped, recorded or photographed (collectively, the “Recordings”) and that such Recordings may be disseminated on all media now known or hereafter devised, in any and all manner throughout the world in perpetuity. With full title guarantee the participant hereby irrevocably assigns to the organisers (including present assignment of future copyright) the entire copyright and all other rights of whatsoever nature in and to his/her contributions to the Event, including but not limited to submitted questions, appearances and interviews, such that organisers shall be entitled to edit, use and exploit and license others to use and exploit such contributions by all means and in all media and formats whether now known or hereafter invented throughout the Universe for the full period of copyright including any extensions and renewals thereto and thereafter insofar as is possible in perpetuity. Furthermore, the participant irrevocably grants all consents and waivers as may be required under the Copyright Act of the Republic of Singapore (as may be amended from time to time) (the “Act”) or any similar laws of any jurisdiction to enable the organisers to make fullest use of the Programme or any part thereof without restriction. For the avoidance of doubt, the organisers may edit, adapt, translate or remove any part of the participant’s performance and/or contribution. For the avoidance of doubt, the participant acknowledges and agrees that the copyright and all intellectual property rights in and to the format of the Event vests in the organisers.
7. Each participant’s personal data will be collected, used, disclosed and/or processed by the organisers and the organisers group of companies (collectively the “The Organisers’ Group”) for the following purposes: (a) for the organisation of this Event; and (b) to comply with any request from any third party or any order of court or directive from authorities investigating any alleged offence or misconduct or for the purposes of taking legal action against you.
8. By agreeing to these Terms and Conditions, you:
a) consent to the organisers collecting, using, disclosing and/or processing your personal data for the purposes as described in Clause 7 above;
b) consent to the organisers transferring your personal data out of Singapore to the organiser’s third-party service providers or agents for the purposes as described in Clause 7 above. If you have any questions relating to the organiser’s collection, use and disclosure of your personal data, please contact the organiser’s Data Protection Officer at events@funco.com.sg.
9. Participants shall bear their own costs and expenses incurred and/or arising from their participation in the Event and no reimbursement may be sought from the organisers.
10. Participants shall abide by all rules and regulations specified by the organisers in relation to the Event (including any safety and security measures).
11. The participant shall not, without the prior written consent of the organisers, speak to the press or other media nor give any interviews or comments relating to the Event.
12. The organiser’s decision on all matters in relation to the Event is final. No enquiries, appeals, verbal or written, shall be entertained. The participant shall accept and abide by any and all decisions made by the organisers concerning, without limitation, these Terms and Conditions, the rules of participation in the Event, and any other matters relating to the Event.
13. The organisers reserve the right to amend or vary any of these Terms and Conditions and/or details of the Event, or to postpone or cancel the Event without prior notice to any participant. The organisers further reserve the right, without any liability to any participant(s), to disqualify any participant(s) from attending and/or participating in the Event at any time at its discretion.
14. The participant shall indemnify and keep the organisers and its related/a ffiliated companies, officers, agents and employees (the “Indemnified Parties”) fully indemnified against any and all loss, damage, claims and costs (including legal costs on a full indemnity basis) suffered and/or incurred by any of the Indemnified Parties as a result of the participant’s breach of any of these Terms and Conditions.
15. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore. The participant irrevocably submits to the non-exclusive jurisdiction of the courts of the Republic of Singapore. No third party shall have any rights under the Contracts (Rights of Third Party) Act of the Republic of Singapore.
ACKNOWLEDGEMENT, RELEASE AND INDEMNITY
In consideration of the organisers agreeing to allow me to participate in the abovementioned Event, I hereby covenant and agree with the organisers as follows:
1. I fully understand and acknowledge that THE EVENT IS POTENTIALLY DANGEROUS and in choosing to participate, I acknowledge that I ACCEPT ALL RISKS ASSOCIATED WITH THE EVENT AND ACTIVTIES OFFERED DURING THE EVENT and that such acknowledgement is a condition precedent to me taking part in any capacity in the Event.
2. I warrant that I am not presently receiving treatment for or su ering from any illness, disorder, injury or any other medical condition which may render it unsafe for me to take part in the Event. If I feel unwell prior to or during the Event, I agree that I shall abstain from participating in the Event.
3. I for myself, my executors, administrators and other personal representatives acknowledge that the organisers, its respective related/affiliated companies, and its respective officers, employees, servants and agents will not be responsible or liable for, and release and forever discharge the organisers, its related/affiliated companies and its officers, employees, servants, agents and all persons authorized by it or them or any of them from, any claim, liability, damages, cost, loss or expense whatsoever in respect of: arising out of my participation in the Eventor arising from compliance with the above terms and conditions relating to the Event (as may be amended from time to time) and I agree that this Acknowledgement, Release &
Indemnity (“Acknowledgement”) may be pleaded to any such claim.
4. The releases contained in Clause 3 shall operate in respect of any loss or damage sustained or suffered however caused, including loss or damage suffered due to the negligence, omission, lack of reasonable foresight, lack of reasonable care or failure to take adequate precaution by the organisers, its related/a affiliated companies and its officers, employees, servants and/or agents.
5. I warrant and acknowledge that I have not relied upon any expertise, representation, warranty or statement whatsoever of the organisers, their respective related/affiliated companies and/or their respective officers, employees, servants or agents in choosing to participate in the Event and I further acknowledge that the organisers has advised that neither it, nor its related/affiliated companies, their respective officers, employees, servants or agents have any experience or expertise whatsoever in relation to the activities involved in the Event. I understand that the organisers and its related/affiliated companies, their respective officers, employees, servants or agents are not actually suppliers of such activities.
6. I hereby indemnify and will keep the organisers, its related/affiliated companies and their respective officers, employees, servants or agents indemnified against any claim, demand, writ, summons, suit, action, proceeding, judgment, order, decree, damages, costs, loss or expense of any nature arising out of any breach of representation, warranty or undertaking herein or in relation to my participation in the Event.
7. In the event that any clause or part-clause of this Acknowledgement is deemed invalid or unenforceable, then the remaining clauses and part-clauses shall remain in full force and effect, and so far as possible, the said clause or part-clause shall be deemed modified to the minimum degree possible so as to comply with applicable law and be valid and enforceable.
8. This Acknowledgement shall be governed by and construed in accordance with Singapore law.
EVENT
1. T-shirt sizes are subject to availability.
2. There is no medal to be issued on the day of the Event at the Finishing Area, upon completion of the Walk. This is a non-competitive Event.
3. The Event will be held on Saturday, 29 August 2026, from 7.30am to 10.30am at Angsana Green, East Coast Park, Singapore.
4. The Organiser reserves the right to amend the Walk routes as they deem fit for the safety of the Participants and/or to prevent any potential hazards in the running of the Event, at any time without prior notice to the Participants. In such cases, every effort will be made to inform the Participants before the date of the Event. The Organisers shall not be liable for any other loss or inconvenience caused due to such changes.
5. Participants must wear their Event T-shirt at all times during the Walk.
6. The Organiser reserves the right to delay the commencement of the Walk in the event of inclement weather.
7. Should inclement weather persist after the delay, the Organiser reserves the right to cancel the Event without refund of donation or registration fees, if any.
8.Participants who do not start within 10 minutes from their respective flag-off point, should consider removing themselves from the Walk and for safety reasons, will not be allowed to start. The cut-off timing for the walk is 1.5 hours.
